The School Bus “Danger Zone”

As unbelievable as it may sound, there are a large number of fatal accidents which continue to occur in this country involving students while getting on and off the school bus.

According to published figures from the Kansas Department of Transportation and other sources confirm that fatalities and injuries in the loading and unloading zone, rightfully called the ‘danger zone’, accounted for 13 fatal accidents, involving K-12 school children. Of the 13 fatalities, 7 occurred behind the bus and 6 were killed by a passing motorist.

Pedestrian fatalities at the ‘danger zone’ are three times as many as school bus occupant fatalities. This makes the time of getting on and off the school bus, one of the most potentially dangerous part of the bus ride.

The reason why the ‘danger zone’ is potentially so hazardous is because this is the area on all sides of the bus where the children are not seen by the driver (ten feet in front of the bus where the driver may be seated too high or ten feet on either side of the bus where a child may be in the driver’s blind spot, and the area behind the school bus).

Considering the rise in such fatalities there have been several mandatory product and design changes in school buses implemented. For instance, the federal rule requires all new buses to have an 8-amp lamp warning system and stop signal arm.

While the number of such accidents in the ‘danger zone’ has significantly reduced over the years, the School Transportation Section of the National Safety Council recommends that training on various aspects of getting on and off the bus should be given both to pupils and students.

Here are some simple guidelines which you could train your child while he is getting ready to get on and off his school bus:

– Avoid any rowdy behavior while waiting for the bus. Stay calm and do not stray on to the streets.

– Remain away from the street as the bus approaches.

– After entering the bus, find a seat and sit down.

– Keep your head, neck and arms inside the bus.

– When the school arrives, wait for the bus to come to a complete halt before getting up from the seat.

– Keep the aisle of the bus clear of clutter.

– Walk at least 10 feet ahead of the bus along the side of the road, if you have to cross the road in front of the bus.

– Wait for the driver to give you the ‘walk’ signal before you start to cross the road.

– While crossing the road, keep your eyes for oncoming traffic.

– Always stay away from the rear wheels of the bus.

When you use an online travel agency like Expedia, Travelocity, etc. you aren’t able to have someone protect your back. They book the travel for you and then you are pretty much on your own. Say your flight gets cancelled, who is going to book a replacement flight? You are, not them. If you use a travel professional that travel professional will do it. If something goes wrong on your trip, if the room you booked is not like what you thought it would be, who is going to make it right? This is not always true. True, some travel professionals charge fees but not all of them do. This is because some vendors, like airlines and some hotels, don’t pay commission or some of the vendors have decreased the amount of commissions paid to the travel professional. In order to make ends meet, some travel professionals charge fees. I charge $50 per person for airline reservations domestically and $100 for airline reservations internationally. I will also charge a fee sometimes for hotels for the same reason or if I am putting the various sections of the trip together myself. If I book a cruise or a tour, I don’t charge a fee as the vendor pays me a commission. Remember, whether you use a travel professional or not the commission is still being paid as it is automatically included in the price from the vendor. So, why not use a travel professional and avoid the hassle and save your time?

Examples: Passports

For instance, did you know that come January, 2016 you may need a passport to travel by air domestically? This is due to a law called the REAL ID Act. This requires all travelers to have a REAL ID compliant identification that includes all of these fields: full legal name, signature, date of birth, gender, unique identifying number, a principal residence address and a front-facing photograph of the applicant. Unfortunately there are still a handful of states that are non-compliant. Do you know which states are compliant and which aren’t? Your travel professional does. By the way, outright non-compliant states/territories are American Samoa, Louisiana and New Hampshire. The states of Minnesota and New York offer an optional Enhanced ID at a cost, so because it is optional, a large percentage of residents don’t have one. Some states have applied for additional extensions, but it is unclear if those will be granted. Currently, only four states (Louisiana, Minnesota, New Hampshire and New York) and American Samoa are technically non-compliant.

Also, we still don’t know if January 1, 2016 will be the date of the requirement or will it be later? Because of this law, the passport processing time for all will be affected. All the passports issued in 2006 to meet the Western Hemisphere Travel Initiative that went into effect in 2007 are now expiring, causing a slew of renewals. So, because of those renewals coupled with the possible REAL ID enforcement, passport waits are expected to further increase. As of October 11, the current wait has already increased a week to four to six weeks for standard passports and three weeks for expedited. Expedited in person could be up to eight days based on travel need.

Ultimately the REAL ID Act will require all state-issued drivers’ licenses to include “machine-readable technology” or chips to help keep us safe and secure while traveling.

Also, passports are recommended for cruises just like they are required to fly outside of the United States. The reason being is if you do need to fly back to the United States from a foreign port you have a passport to do so. Just because you are on a cruise leaving a United States port, technically you are traveling internationally just as soon as you step on the ship as most ships are registered outside of the United States!

Example: Visas

A travel professional would be able to help you determine if visas are required to travel to where you want to go. If they don’t know for sure, they know where to send you for that information and get confirmation that you do or don’t need one for the type of travel you are taking. For instance, for most cruises if you leave an U.S. port and return to the same U.S. port you probably don’t need a visa to visit the ports. This is called a “closed loop” trip. But, again, most of the cruises. Always double check to see if one is needed.

Some health insurance companies do not cover you when traveling outside of the United States. Medicare does not. Travel insurance will act as your primary health insurance during your travel, from the time you leave to the time you return to your home. The decade has just ended and we are once again starting out on a clean slate. The last decade’s fashion saw the emergence of recycling the trends prior to it most notably from the 90’s. During the first few years, 90’s fashion was evident. However, at this time, it was more refined. Prevalent in this year as well was stepping away from the unisex style of dressing. The more “woman approach” was now being embraced as skirts and dresses become more in-style.

The youth played an important role in fashion during these times specifically in the early 2000’s. Emo and hip-hop style were the in-thing mainly because of the rise of emo bands and new hip-hop artists. These artists have influenced the way people dress and live. Hoodies and sweatpants were among the most popular garments used last decade. You see Eminem wear these types of clothing and other hip-hop moguls as well. Baggy pants and lose denims were also common and are not only worn by men but by women as well. This type of style however was again based on the 90’s fashion.

Emo style, on the other hand, is associated with wristbands and spiky hair. Sometimes, this is accompanied with dark eye shadows and black fit shirts. Blink 182, and Green Day were among those who influenced the youth for this fashion.

Sophisticated garments such us black pants and black dress shoes became popular. There was quite a shift of fashion style in hip-hop when Kanye West introduced the lesser youthful hip-hop style. Loose shirt and pants were now replaced for a more manly look. Power suits were also worn at this time. Usually, these kinds of clothing are used only during formal occasions. Yet, these became popular and are widely used even during casual events.

If saggy clothes were fashionable in the 90’s, during this decade, tight jeans became widespread. Designer jeans were more popular at this time. Of course, what is fashion without the accessories? During the last decade, fashion was also associated with designer glasses, both for men and women. The “geek look” was something people have wanted to portray. For guys, in particular, baseball caps were extremely popular for teenagers. However, these kinds of caps cannot be bent so they stay as they are.

What Next in the World of Tax Preparers Oversight?

The last three weeks have been rather eventful in the world of tax preparers oversight!

It all started last March when three tax preparers filed a law-suit against the IRS, seeking to end the testing requirements that would require tax return preparers to demonstrate competency, and to maintain proficiency by taking 15 hours of continuing education courses, in order to continue preparing and file tax returns for their clients.

A couple weeks ago came the news that U.S. District Court Judge James E. Boasberg of the DC District Court had ruled in favor of the plaintiffs, declaring that contrary to the IRS’ assertions, the agency does not have statutory powers to regulate individual tax preparers. The Judge enjoined the IRS from continuing to administer tests to certify the competence of tax return preparers.

Last week it was announced that the IRS, working in conjunction with the Justice Department, had moved to lift the initial injunction, while it prepared an appeal to be filed within the next 30 days.

The lead attorney for the tax preparers who filed the suit against the IRS was confident after the initial decision emitted by Judge Boasberg was definitive and unequivocal in its intent to halt the IRS regulation requiring individual tax preparers to take a competency test, and expressed confidence that the Judge would not go back on that decision.

However, on February 1, the Judge responded to the motion from the IRS, in conjunction with Department of Justice and modified his earlier decision. At least for the time being, the IRS does not have to shut down the tax return preparers registration program but, on the other hand, under the modified decision the Judge made it non-mandatory for tax preparers to take the competency test and pay the required testing fees to the IRS. Under the Judge’s modified ruling, preparers may take the test on a voluntary basis and are not required to pay the test fees. However, tax preparers are still required to apply for and obtain a registration number, or PIN, from the IRS, in order to qualify to file tax returns.

Under the new ruling, the IRS does not have to dismantle the costly and complex program it already put in place at a cost of millions of dollars, as such steps would have proven unnecessary should the present court decision be reversed on appeal.

The IRS has indicated that it will appeal the US District Court’s ruling that the agency does not have the power to license the hundreds of thousands of tax preparers who work on individual tax return preparation, and alludes to the fact that immediate discontinuing of the tax preparer oversight program would substantially disrupt tax administration. Already, there has been a delay on the date to begin filing individual returns, which was moved to January 30. Some returns will not start being processed until later.
